Artículo 53
Las acciones de prevención, persecución y sanción de los delitos, así́ como la reinserción social de las personas condenadas, serán desarrolladas por los organismos públicos que señalen esta Constitución y la ley, en forma coordinada y con irrestricto respeto a los derechos humanos.
El abogado constitucionalista y académico de la Universidad Adolfo Ibáñez, Rodrigo Correa, aclara que no hay una interpretación correcta en la franja aludida porque el texto no incluye la palabra «solo».

¿Y qué hay con las fundaciones?
El jurista dice: «el Estado puede crear fundaciones y corporaciones conforme al derecho civil, o puede crearlas por ley sujetas a la reglas que la misma ley establezca».
