Durante el debate ARCHI de segunda vuelta, ante la pregunta de la periodista Constanza Santa María sobre si revisaría o derogaría la Ley de 40 Horas laborales, el candidato republicano respondió:
“Solo voy a decir que vea cómo lo votamos”

Esta afirmación, sumada a la respuesta evasiva sobre una posible derogación, ha generado debate sobre la postura histórica del Partido Republicano frente a esta normativa promulgada en 2023.
En este explicativo revisamos los registros oficiales del Congreso Nacional para verificar cuál fue la postura legislativa del partido respecto a esta ley promulgada en 2023.
El detalle de la votación
Para entender la frase «vea cómo votamos», es necesario ir al 11 de abril de 2023, fecha en que se realizó el tercer y último trámite en la Cámara de Diputadas y Diputados donde se aprobó la la ley que reduce la jornada laboral de 45 a 40 horas.
El proyecto fue aprobado por una amplia mayoría con 127 votos a favor. Sin embargo, hubo catorce votos en contra y tres abstenciones. De estos votos negativos, doce correspondieron a la bancada del Partido Republicano, quienes decidieron rechazar la propuesta de manera unánime.
Días antes de la votación, el Partido Republicano criticó públicamente el proyecto, advirtiendo las consecuencias económicas que la ley traería al país.
“Tanto el oficialismo como la oposición han entusiasmado a la gente con una medida populista que más temprano que tarde terminará perjudicando a la gran mayoría”.

El día de la votación, todos los votos en contra provinieron del Partido Republicano, tal como lo habían adelantado públicamente.

El registro también coincide con la propia reacción pública de José Antonio Kast. Ese mismo 11 de abril, tras la votación, el líder republicano publicó un mensaje en su cuenta de X felicitando a la bancada por rechazar en bloque la iniciativa, destacando su postura y reforzando el respaldo al voto contrario del partido.
Es importante destacar que, aunque varios de ellos hoy –finales de 2025– figuran como independientes o en nuevos movimientos (como el Partido Nacional Libertario), al momento de la votación formaban parte activa de la bancada Republicana.
